Summary:

This user agreement pertains to the license of copyrighted software by pH Games and its online services. As such, this user agreement is comprised of both a EULA (End User License Agreement) and Terms of Service. By using software created by pH Games, you agree to both. Two key points are as follows:

• Ownership and Piracy

• Legal / Safety

Ownership and Piracy:

 

Always-on DRM (Digital Rights Management) and / or Periodic Online Checks are required to prevent piracy. Should DRM fail, the software will be rendered unusable. You are not allowed to distribute or make commercial use of anything we have made without our permission. You are not allowed to make commercial use of modified files in the existing software.

What about the content that you make using software by pH Games?

• User-generated content may be included in software updates under the following condition:

  • The user-generated content was freely distributed. Its creator(s) will be appropriately credited and may also receive special rewards

• All other user-generated content is owned by its creator(s)

Legal / Safety:

 

All software released by pH Games is unrated or given an ESRB (Entertainment Software Rating Board) rating of ADULTS ONLY 18+. This doesn't necessarily mean the software contains content to warrant such a rating, it is simply there to mitigate the risk of failed legal compliance. There are an infinite number of obscure legal cases that cannot be avoided. As such, the only solutions are either a dedicated legal team or the aforementioned ratings. User discretion is advised. That being said, the following well-known value shall be upheld by both users and pH Games alike:
